1. Scope
These Terms and Conditions apply to all orders placed by consumers via the Froyé online shop.

A consumer within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

3. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.
By submitting an order, the customer makes a binding offer to conclude a purchase contract.
The contract is only concluded upon our explicit acceptance, for example through an order confirmation by email, a shipping confirmation, or dispatch of the goods.
Before submitting the order, the customer has the opportunity to identify and correct input errors.
The contract text is stored by us. Order details and these Terms and Conditions are sent to the customer by email.
We reserve the right to refuse an order, particularly if a product is unavailable, obvious pricing errors exist, or there is suspicion of misuse.

The contract language is German.
5. Prices and Shipping Costs
All prices are stated in euros.
Additional shipping costs are shown separately in the respective product offer, shopping cart, or checkout process.
6. Payment
Available payment methods are displayed during checkout.
Depending on availability, the following methods may be offered:
Klarna, Mastercard, American Express, Maestro, UnionPay, Shopify Payments, PayPal, Apple Pay, Google Pay, MobilePay, EPS, Bancontact
Payment is generally due immediately upon completion of the order, unless otherwise specified during checkout.
When using external payment service providers, their respective terms and conditions and privacy policies also apply.
7. Delivery
Delivery is made to the address provided by the customer.
We currently deliver to the following countries:
Austria, Germany, Albania, Andorra, Belarus, Belgium, Bosnia and Herzegovina, Bulgaria, Denmark, Estonia, Finland, France, Greece, Ireland, Iceland, Italy, Kosovo, Croatia, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Moldova, Monaco, Montenegro, Netherlands, North Macedonia, Norway, Poland, Portugal, Romania, Russia, San Marino, Sweden, Switzerland, Serbia, Slovakia, Slovenia, Spain, Czech Republic, Turkey, Ukraine, Hungary, Vatican City, United Kingdom, Cyprus
Delivery times are stated in the respective product offer or during checkout.
Unless otherwise stated, delivery within Austria takes approximately 1–2 business days and within the EU approximately 2–7 business days.
If a product is unavailable, we will inform the customer without delay.
For consumers, the risk of accidental loss or deterioration of the goods passes only upon delivery to the consumer or a person designated by the consumer.
8. Retention of Title
The goods remain our property until full payment has been received.
9. Right of Withdrawal / Cancellation
Consumers generally have a statutory right of withdrawal.
Details regarding conditions, deadlines, and exercise of the right of withdrawal are provided in our separate withdrawal policy.
10. Exclusions from the Right of Withdrawal
The right of withdrawal does not apply in particular to goods that are made to customer specifications or clearly personalized.
This includes in particular:
personalized jewelry
engraved jewelry
custom-made products
individually adjusted sizes
customer-specific special orders
The right of withdrawal may also be excluded for sealed goods that are not suitable for return for health protection or hygiene reasons once the seal has been removed. This may apply in particular to earrings.
11. Returns
In the event of a valid withdrawal, the customer must return the goods without undue delay and no later than 14 days from the day on which they informed us of the withdrawal.

The customer bears the direct cost of return shipping, provided they have been properly informed.
The product must be returned unused and in its original packaging.
12. Refunds
If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except additional costs resulting from your choice of a different delivery method than the least expensive standard delivery offered), without undue delay and no later than 14 days from the day we receive notification of your withdrawal.
Refunds will be made using the same payment method used for the original transaction unless otherwise expressly agreed. No fees will be charged for the refund.
We may withhold reimbursement until we have received the goods back or you have provided proof of return shipment, whichever is earlier.
The customer must return or hand over the goods without undue delay and in any event no later than 14 days from notifying us of the withdrawal. The deadline is met if the goods are dispatched before the 14-day period expires.
13. Warranty
Statutory warranty rights apply.
A defect exists in particular if the goods do not have the agreed characteristics or are not suitable for their usual use at the time of delivery.
Natural material properties do not constitute a defect.
925 sterling silver may naturally tarnish or oxidize over time. This is a natural chemical process and does not constitute a product defect.
Tarnishing or oxidation of sterling silver therefore does not constitute a defect under warranty law.
For gold-plated jewelry, wear of the plating due to use, skin contact, sweat, water, perfume, cosmetics, cleaning agents, or other external influences does not constitute a defect.
Damage caused by improper use, impact, pulling, chemical contact, water, perfume, cosmetics, or improper cleaning is excluded from warranty coverage.
14. Guarantee
Any additional guarantee exists only if explicitly stated for the respective product.
Statutory warranty rights remain unaffected.
15. Product Information
Essential product characteristics are provided in the respective product description.
For jewelry, this may include:
material
silver content
gold plating
type of coating
stones or decorative elements
dimensions
weight
care instructions
water resistance information
nickel-free status (if applicable)
The customer is obliged to carefully read the product description before placing an order.
16. Product Representation
Product images in the online shop may differ slightly from the actual products.
In particular, colors, surface appearance, size perception, and details may vary due to different screen settings.
Handmade jewelry may show slight variations. Such variations are a natural result of craftsmanship and do not constitute a defect unless they significantly affect the agreed characteristics.
17. Note on AI-Generated Images
AI-generated images or illustrations are used solely for decorative, atmospheric, or design purposes.
Only the product description is legally binding regarding product characteristics, including material, dimensions, gold plating, silver content, stones, and care instructions.
Each AI-generated product image is marked with a logo in the lower right corner.
18. Care Instructions
Customers must follow the care instructions provided on the website and in the product description.
In particular, jewelry should be protected from water, perfume, sweat, cosmetics, cleaning agents, chlorine, saltwater, and other chemicals unless otherwise stated.
Gold-plated jewelry requires special care, as the plating may wear off over time due to friction and external influences.
19. Liability
We are fully liable for damages resulting from injury to life, body, or health caused intentionally or negligently.
For other damages, we are only liable in cases of intent or gross negligence.
In cases of slight negligence, we are only liable for breaches of essential contractual obligations, the fulfillment of which is essential for proper execution of the contract and on which the customer may regularly rely.
Liability under mandatory statutory provisions remains unaffected.
20. Vouchers and Discount Codes
Vouchers and discount codes may only be redeemed within the specified period and under the stated conditions.
Cash payment is excluded.
Only one voucher or discount code may be used per order unless explicitly stated otherwise.
21. Applicable Law
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers, this choice of law applies only insofar as it does not deprive them of mandatory legal protections of the country in which they have their habitual residence.
22. Dispute Resolution
We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
23. Final Provisions
If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
