1. Scope
These Terms and Conditions apply to all orders placed by consumers through the Froyé online shop.

A consumer within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
2. Contracting Party

3. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
By submitting an order, the customer makes a binding offer to conclude a purchase contract.
The contract is concluded only upon our express acceptance, for example by an order confirmation by email, a shipping confirmation or dispatch of the goods.
Before submitting an order, the customer has the opportunity to identify and correct input errors.
The contract text is stored by us. Order details and these Terms and Conditions are sent to the customer by email.
We reserve the right to refuse an order, particularly where a product is unavailable, an obvious pricing error exists or there is reasonable suspicion of misuse.
4. Contract Language
The contract language is German.
The English version of these Terms and Conditions is provided for information purposes. In the event of any discrepancy between the German and English versions, the German version shall prevail, unless mandatory statutory provisions provide otherwise.
5. Prices and Shipping Costs
All prices are stated in euros.
Any additional shipping costs are shown separately in the relevant product offer, shopping cart or checkout process.
The applicable shipping costs are displayed to the customer before the order is completed.
6. Payment
Available payment methods are displayed during checkout.
Depending on availability, the following payment methods may be offered in particular:
Klarna, Mastercard, American Express, Maestro, UnionPay, Shopify Payments, PayPal, Apple Pay, Google Pay, MobilePay, EPS and Bancontact.
Payment is generally due immediately upon completion of the order unless otherwise stated during checkout.
When external payment service providers are used, their respective terms and conditions and privacy policies also apply.
7. Delivery
Delivery is made to the delivery address provided by the customer.
We deliver to the countries available for selection in the online shop or during checkout for the relevant order.
Applicable shipping costs and available delivery methods are displayed before the order is completed.
Unless otherwise stated, estimated delivery times after handover to the shipping provider are:

1–3 business days within Austria,

2–5 business days within Europe,
-
3–8 business days for destinations outside Europe.
Any processing time before dispatch may be stated separately.
If a product is unavailable, we will inform the customer without undue delay.
For consumers, the risk of accidental loss or deterioration of the goods generally passes only upon delivery to the consumer or a person designated by the consumer, unless mandatory law provides otherwise.
8. Retention of Title
The goods remain our property until payment has been received in full.
9. Statutory Right of Withdrawal
Consumers entering into distance contracts generally have a statutory 14-day right of withdrawal.
For goods, the withdrawal period begins upon receipt of the goods. The day on which the goods are received is not counted when calculating the period.
Where several goods forming part of a single order are delivered separately, the withdrawal period generally begins upon receipt of the last item.
To exercise the statutory right of withdrawal, the consumer must clearly inform Froyé of the decision to withdraw from the contract before the withdrawal period expires.
The consumer may do so, in particular, by email to info@froye.at, through any electronic withdrawal function provided by Froyé, or by using the model withdrawal form provided by Froyé.
Use of the model withdrawal form is not mandatory.
To meet the withdrawal deadline, it is sufficient for the communication concerning the exercise of the right of withdrawal to be sent before the withdrawal period expires.

In addition to the statutory right of withdrawal, Froyé offers a voluntary return policy under the conditions set out below until the end of a total of 30 calendar days after receipt of the order.
The statutory right of withdrawal and any other mandatory consumer rights remain fully unaffected.
10. Exceptions to the Statutory Right of Withdrawal
10.1 Personalised and Custom-Made Products
The statutory right of withdrawal may in particular be excluded for goods made to customer specifications or clearly personalised to the consumer's individual requirements, provided the applicable statutory conditions are met.
This may include personalised jewelry, engraving, custom-made items or products individually produced according to customer specifications.
10.2 Earrings and Hygiene Seal
Special return conditions apply to earrings for hygiene reasons.
Froyé supplies earrings with a hygiene seal.
As long as the hygiene seal remains complete and intact, the consumer's statutory withdrawal rights remain unaffected.
Once the hygiene seal has been removed or opened after delivery, the statutory right of withdrawal for the relevant earring ceases, provided the applicable statutory conditions for the exclusion of sealed goods for health protection or hygiene reasons are met.
Consumers should therefore make sure they wish to keep the earring before opening the hygiene seal.
Regardless of the above, earrings are entirely excluded from Froyé's voluntary return policy from Day 15 to Day 30. This applies even if the hygiene seal remains intact.
These restrictions do not apply to legitimate claims relating to defective, damaged or incorrectly delivered earrings.
Mandatory statutory rights relating to defective goods remain fully unaffected.
11. Returns Following a Statutory Withdrawal
11.1 Return Deadline
Following a valid statutory withdrawal, the consumer must return the goods without undue delay and no later than 14 calendar days from the day on which the consumer informed Froyé of the withdrawal.
The deadline is met if the goods are dispatched no later than the final day of this 14-day period.
11.2 Return Address

11.3 Return Shipping Costs
For a standard return where the product is not defective, the consumer bears the direct cost of returning the goods, provided the consumer was properly informed of this before entering into the contract.
This also applies to returns made under the statutory right of withdrawal.
If a product is defective or damaged, or if the wrong product has been delivered, Froyé must be contacted at info@froye.at before the goods are returned.
Where a legitimate defect exists and return of the goods is required, Froyé will cover the necessary return shipping costs.
11.4 Condition and Completeness of the Return
The consumer is asked to return the product together with all components supplied with the relevant product.
These include in particular:

the original packaging,
-
the Froyé pouch,
-
all product-related cards, and
-
all other packaging and accompanying elements supplied with the product.
Under the statutory right of withdrawal, the consumer may inspect the goods to the extent necessary to establish their nature, characteristics and functioning.
Complete original packaging is not a condition for validly exercising the statutory right of withdrawal.
The consumer is liable for any diminished value only where it results from handling the goods beyond what is necessary to establish their nature, characteristics and functioning.
12. Refunds and Voluntary 30-Day Return Policy
12.1 Refunds Following a Statutory Withdrawal
In the event of a valid statutory withdrawal, Froyé will refund all payments received from the consumer, including the cost of the least expensive standard delivery option offered by Froyé.
Additional costs resulting from the consumer choosing a different or more expensive delivery method than Froyé's least expensive standard delivery option will not be refunded.
Unless expressly agreed otherwise, the refund will be made using the same payment method used for the original transaction.
Refunds will be made without undue delay and within the applicable statutory deadlines.
Froyé may withhold reimbursement until either:

the returned goods have been received by Froyé, or
-
the consumer has provided evidence that the goods have been returned,
whichever occurs first.
Once the requirements for reimbursement have been met, Froyé will initiate the refund within one business day at the latest, while all mandatory statutory refund deadlines will in any event remain applicable.
Once Froyé has submitted the refund to the relevant payment provider, additional processing time may be required before the amount becomes visible in the consumer's account or on the original payment method.
This subsequent processing time depends on the relevant payment provider or bank and is outside Froyé's control.
12.2 Voluntary Return Policy from Day 15 to Day 30
In addition to the statutory right of withdrawal, Froyé offers a voluntary return policy until the end of the 30th calendar day after receipt of the order.
The period begins on the day after receipt of the goods.
The return must be registered with Froyé no later than the end of the 30th calendar day.
If the return request reaches Froyé after this deadline, the customer is no longer eligible for a return under the voluntary return policy.
The return may be registered within this period by email to info@froye.at.
Froyé will process the return request within one business day at the latest and provide the consumer with the necessary return instructions.
12.3 Return Deadline Following Registration of a Voluntary Return
Once the return has been registered within the applicable period, the consumer has 14 calendar days to dispatch the goods.
This period begins on the day after the return is registered.
The return deadline is met if the goods are dispatched no later than the final day of this 14-day period.
If the goods are not dispatched within this period, eligibility under the voluntary return policy expires. Froyé may decline a return dispatched after this deadline.
The 30-day period therefore relates to the registration of the return. The goods do not need to have physically arrived at Froyé within those 30 days.
12.4 Conditions of the Voluntary Return Policy
For a return to be accepted under the voluntary return policy, all of the following conditions must be met:

The product is unworn.

The product is undamaged.

The product is complete.
-
The product is in a condition suitable for resale.

The complete original packaging is returned.
-
The Froyé pouch is returned.
-
All product-related cards are returned.
-
All other packaging and accompanying elements supplied with the product are returned in full.

The product is not excluded from the voluntary return policy.
If the original packaging, Froyé pouch, product-related cards or any other supplied components are missing, or if the product otherwise fails to meet the conditions above, Froyé may decline the return under the voluntary return policy.
Earrings are entirely excluded from the voluntary return policy, even where the hygiene seal remains intact.
12.5 Costs Under the Voluntary Return Policy
The consumer bears the direct cost of return shipping for returns made under the voluntary return policy.
Original delivery charges paid for the order are not refunded under the voluntary return policy.
Legitimate claims relating to defective, damaged or incorrectly delivered goods remain unaffected.
12.6 Inspection and Refund Under the Voluntary Return Policy
Once the returned goods have arrived, Froyé will inspect the return to determine whether all conditions of the voluntary return policy have been met.
Receipt of the goods by Froyé does not automatically constitute acceptance of the return.
If the return is accepted following inspection, Froyé will initiate a refund of the purchase price of the accepted returned products within one business day after completion of the inspection.
Unless otherwise agreed, the refund will be made using the payment method used for the original order.
Once Froyé has submitted the refund to the relevant payment provider, additional processing time may apply depending on the payment method, payment provider and bank.
This subsequent processing time is outside Froyé's control.
12.7 Business Days
For the purposes of these provisions, business days are Monday to Friday, excluding public holidays in Austria.
13. Statutory Rights Relating to Defective Goods
13.1 Statutory Rights
Applicable statutory rights relating to defective goods apply.
A defect exists in particular where, at the time of delivery, the goods do not have the agreed characteristics or otherwise fail to meet the applicable statutory requirements for conformity.
Mandatory statutory rights of consumers relating to defective goods are not restricted by the voluntary return policy, the return conditions or any other provision of these Terms and Conditions.
13.2 Defective, Damaged or Incorrectly Delivered Goods
If a product is defective or damaged, or if the wrong product has been delivered, the consumer is asked to contact Froyé at info@froye.at before returning the goods.
Froyé will process the request within one business day at the latest and inform the consumer of the next steps.
Where a legitimate defect exists and return of the goods is required as part of the statutory remedy, Froyé will cover the necessary return shipping costs.
Where a full return of the product is required, the consumer is asked to return the product together with the original packaging, Froyé pouch, product-related cards and all other packaging and accompanying elements supplied with it.
However, the absence of individual packaging or accompanying elements does not restrict mandatory statutory rights relating to defective goods.
These provisions also apply to earrings.
13.3 Natural Material Characteristics and Wear
Natural material characteristics do not generally constitute a defect.
925 sterling silver may tarnish or oxidise over time due to the natural characteristics of the material. This is generally a natural chemical process and not a material or product defect.
Natural tarnishing or oxidation caused by the characteristics of 925 sterling silver therefore does not generally constitute a defect for the purposes of statutory rights relating to defective goods.
For gold-plated jewelry, the plating may wear over time depending on use, skin contact, sweat, water, perfume, cosmetics, cleaning products or other external influences. Ordinary wear resulting from use does not generally constitute a defect.
Damage occurring after delivery as a result of improper use, impact, excessive pulling, improper cleaning or handling contrary to the stated care instructions does not generally constitute a defect for which Froyé is responsible.
Mandatory statutory consumer rights remain unaffected in all cases.
14. Guarantee
An additional guarantee applies only where it is expressly stated for the relevant product or elsewhere in the online shop.
Any expressly offered guarantee is subject to the guarantee terms stated in connection with that guarantee.
Statutory rights relating to defective goods remain fully unaffected by any additional guarantee.
15. Product Information and Material Details
The essential characteristics of each product are set out in the relevant product description.
For jewelry, relevant information may include in particular:

silver content
-
gold plating
-
type of coating
-
stones or decorative elements
-
dimensions
-
weight
-
care instructions
-
water-resistance information
-
nickel-free status, where applicable
The customer is responsible for reading the relevant product description carefully before placing an order.
16. Product Representation
Product representations in the online shop may differ slightly from the actual products.
In particular, colors, surfaces, perceived size and details may vary due to different screen settings.
Handcrafted jewelry may show minor variations. Such minor variations are a natural result of craftsmanship and do not constitute a defect unless they materially affect the agreed characteristics of the product.
17. AI-Generated Images
AI-generated images or illustrations may be used solely for decorative, atmospheric or design purposes.
The information stated in the relevant product description is decisive for the characteristics of the product, particularly with regard to material, dimensions, gold plating, silver content, stones and care instructions.
Where a product representation has been generated or edited using artificial intelligence, no product characteristics differing from the relevant product description may be inferred from that representation.
18. Care Instructions
Customers must observe the care instructions provided on the website and in the relevant product description.
Unless otherwise stated in the product description, jewelry should in particular be protected from contact with water, perfume, sweat, cosmetics, cleaning products, chlorine, salt water and other chemical substances.
Gold-plated jewelry requires particular care, as the plating may wear over time due to friction and other external influences.
19. Liability
We are fully liable for damage resulting from injury to life, body or health where such damage is caused by an intentional or negligent breach of duty.
For other damage, we are liable only in cases of intent or gross negligence.
In cases of slight negligence, we are liable only for breaches of essential contractual obligations whose performance is necessary for the proper execution of the contract and on which the customer may reasonably rely.
Liability under mandatory statutory provisions remains unaffected.
20. Vouchers and Discount Codes
Vouchers and discount codes may only be redeemed within the stated period and subject to the applicable conditions.
Cash redemption is excluded.
Only one voucher or discount code may be used per order unless expressly stated otherwise.
21. Applicable Law
Austrian law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For consumers, this choice of law applies only insofar as it does not deprive them of mandatory statutory protections applicable in the country of their habitual residence.
22. Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body unless participation is required by mandatory law.
23. Final Provisions
If any provision of these Terms and Conditions is or becomes wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
